I think their pitch is if you choose the name first you are guaranteed to get it, but if its already reserved through whoever then obviously not, don't think they're claiming exclusive rights just stating the obvious cleverly, how i see it so far anyhow

A reservation is just that, registerys can't hord their tld's from other registraars/the market

You say you have bought some .horse, i've got a few reserved via 1and1 and had none offered yet, a bit perplexed i know m and m are the registraar but i thought it was open source?
