Proposed Directors of Tirupati Graphite explain why they have requisitioned an GM. Watch the video here.
Its all gone the shape of a pear.
(4) Notwithstanding the above, if a company, whose shares represent all or part of the subject-matter of a Spread Bet, goes into liquidation or otherwise becomes insolvent, or is otherwise dissolved or de-listed by the underlying market by reason of the length of its suspension, the day on which the company goes into liquidation, or otherwise becomes insolvent, or is otherwise dissolved or de-listed will be the Expiry Date of that Spread Bet, whether or not the Spread Bet would otherwise have had an Expiry Date. We will deal with your Spread Bet in the following manner: (a) If you hold a buy (up) Spread Bet, the closing level of the Spread Bet will be zero. On closing, a corresponding buy (up) Spread Bet will be opened at zero so that if a company makes a distribution to shareholders, an amount equalling the distribution will be credited to your Account
governing suspended and delisted stocks only to affect bets/trades opened after 10th July 2017 I've been told. Haven't looked myself.
So they'll drag it out.
2. We have also amended Rule 40 governing suspended and delisted stocks to better match the industry standard.
Surely if there is an annulment then there has to be a successful application for a stay of costs? I would have thought the two went hand in hand unless the tribunal were of the belief that CHL we trying to delay making the payment or that we couldn't make the payment?
Contact CHL and they will tell you all you long to hear. Get real people.
Maestro what prices would you give on the various potential outcomes?
I don't know why some people are so surprised at the lack of press coverage. Much more important things don't make news so why should little ol' Churchill Mining. As for Indonesia keeping quiet, what do you expect them to do?
What are the new revelations maestro1? I am unaware of any.
Please inform us of, in your opinion, the 'glaring errors' made by the tribunal in the award? Even if Putra gets banged up for forgery, that does not change the fact that our licences and many, many documents were not authentic. The tribunal don't care who the author/s of the forgeries is/are, they even acknowledge the possibility that it's someone within the regent. The fact remains the documents were not authentic and there was an absence of diligence on our part.
The whole ICSID thing is a big joke. How can these people be counsel on one case and then an arbiter on another case? In that situation one minute they are counsel and are arguing over how something should be interpreted and then on the next case they on the other side of the fence arbitrating and are maybe asked to consider the self same thing by counsel. Surely they are not going to go against something as an arbitrator when earlier, acting as counsel, they were proposing the self same thing? Half of these BITS were negotiated by the people making the rulings. Talk about fingers in every pie!
Thou shall not ramp. You were out of order.
You could knock of 20% for a quick settlement and maybe a little more to cover any other issues that may crop up so nothing less than £5 IMO. When we win this stage no doubt there will be a clear out whilst we wait for the ROI to make an offer and no don't someone willl clean up...perhaps the ROI getting out of some cheaply! I'm looking forward to a great Christmas......
I hear what you say. After reading the Award one can only come to the conclusion that Putra was 'in on it'. All this has been like a soap opera/horror story that's been played out for years. I'd love to meet all the characters. I''ll be quite sad when the last series ends lol. Will we get a happy ending with DQ publicly hanging Putra and what will become of you?
Someone bent within the regent who had an interest in the whole process I guess.
It is undisputed by both parties that the signatures are not hand written therefore it is very worrying when our own witnesses namely Benjamin and Gunter both stressed the importance of obtaining a mining license signed by hand. Benjamin said had he known the licenses were not signed by hand he would have been concerned whilst Gunter called the hand written signature 'the last bastion of power, the only way it would happen'. Our handwriting expert was a joke. Dr. Strach stated the following during cross-examination: “Q.[…] did you perform any field research, if you will, to talk to people in the industry? A. The autopen industry? No, I didn’t. Q. Did you conduct any tests of autopens to see how autopens functioned? A. No, I’ve never had access to an autopen machine. Q. Have you seen an autopen machine? A. Well, you asked that before. No, I haven’t physically seen – I’ve seen online images of autopens and moving images of autopen devices working. Q. Do you know how they actually operate? A. Not in precise detail. .
Well maestro1 I hope you're right. They should hire me as counsel, as a jockey I was good at getting myself out the shit in the stewards room.
At the end of the day the tribunal are of the belief that the 34 documents are not authentic or authorised therefore our claims are inadmissible. Unless we can prove they are authentic and authorised then I don't think we have a leg to stand on and if we can prove that then wouldn't we have done so first time round?
The record reveals that the first time the Claimants engaged in their own forensic assessment of the disputed signatures was through its expert Dr. Strach for the purposes of the present arbitration.
