Regdik, always appreciate your posts. I just wanted to concentrate on one element of your last post, where you said,

[1] If Hope/ OMF do want those shares to cover shorts, there is a question of how clear/ explicit that is possible to be made in the ADR process. I say this as certainly Hope shorting while being on the board is a big no-no and would bring the fiduciary thing back into focus. If he is wanting those shares to cover shorts, he/ they won't be able to make clear why unless between the parties they come to understanding....except that then opens the way for FRR to take this further on the fiduciary element (though FRR may have enough evidence already). If the shorting thing is not out in the open during ADR, then Hope et al need to make clear the reasons for why they believe they are entitled to those shares...
[2] Leaving shorting scrotii to suffer consequences would be great, would love it in fact. However, I do wonder how entangled they all are and whether the shorting scrotii (if they had been colluding heavily) would allow Hope to only save his own 4R53 leaving the scrotii to suffer financial castration? And, as a way-out there onspiracy, ever since the IG under HSBC pay-out of shorts, had wondered if that was some part of the compromise (that payout just seems so bent to me)??
