The FCA mission statement includes the following:
Trust between users and providers of services is necessary for a market to function well. We define trust as a set of beliefs about the honesty and validity of ongoing commitments, which reinforce the belief that future actions will be predictable
and reliable. Our aim is to create a framework that allows fair, open and competitive markets to develop, in which firms’ actions create well justified trust in their products and services.
Where their u-turn in their opposition to the SOA falls within this is a mystery to me, and their blatant distortion of fact during the hearing does not fit with their mission of fairness, openness and honesty.
I have a degree, have had a good career with an extremely good salary, and have chosen to invest some of my money in Amigo, amongst others. I have followed society's rules and, while some may consider me lucky, I consider that all I have achieved and own is gained through honest, hard work and perseverance. Many who have had to rely on Amigo for a loan are less fortunate, and have had genuine need to use that service, and may well be entitled to some compensation so I have no issue with that. There are many though who have acted irresponsibly and deliberately towards personal gain through the failings in the system, which most would agree did exist.
I can see no justification for the court to decide that honest investors, employees and legitimate claimants should suffer loss as the result of the FCA stance. Their role is to ensure trust and honesty in the relationship between all stakeholders, and the events of the past couple of weeks have shown them to be failing miserably in that role.
I think most could foresee some negotiation to get the SOA over the line, and the judge appeared to be exploring options to get to a position of compromise, but the FCA are failing if they can't contribute to finding a solution. Will be extremely disappointing if the outcome of this is insolvency as will be a failing on the part of the parties put there to ensure fairness as it disregards the small person they are there to protect, the employees and legitimate customers.
