76.It was explained at the hearing that a new exclusive licence has now been granted to Illumina, which cures whatever defects were held to exist in the first exclusive licence. That is not a reason, in my judgment, why Illumina's current claim, should be allowed to proceed. Illumina can of course apply to be joined as exclusive licensee on the basis of its new exclusive licence, which seems a very prudent course to have taken. However, it is no answer to the claim of issue estoppel.

just confirms to me that Illumina are not interested in any sort of deal other than the complete removal of the IONA test from the UK market, then maybe followed by Europe.

just hope it's not a further hearing 12 months away.

well the appeal court must have seen something that this Carr chap has missed or done wrong and I know it's a different case but it's so very closely linked that he might change his mind an go in our favour, ha ha ! silly me.
