Good to see that cpx lawyers feel they have a good chance to win the appeal. This time judges will decide on the legal aspects of case and not joe bloggs called up for jury service. The original judge must have directed the Jury to find in favour of the defendant, which is slightly concerning.

Kenny, I didn't realise it was the decision of cpx to go for a jury trial. They would have followed the advice from their lawyers. Why on earth would they want 12 lay people to decide on the technicalities of law, this was a bad decision.

Something to do with not naming the inventors correctly. All a bit vague, need a clear update from cpx

Newuncle, I put the blame on cpx lawyers, they should have carried out due diligence and advised the company accordingly. They should have known the rules around patent law in America.

When applying for the patents in question, it appears the company did not dot all the I's and cross the T's., which has made the patents invalid. If the company now correct their mistake, I don't see how they can appeal the decision, which was originally made on the evidence put before the court. cpx can't just say whoopsie can we have another go.

Newuncle, I understand that each party pays their own legal fees, but there are also court costs to be paid. Are you saying these costs are divided equally between the 2 parties involved .

Very disappointed with the RNS, which said absolutely nothing . cpx lawyers should know straight after the result whether or not there is a case to appeal on a point of law. I feel this waffle by the company just shows contempt towards the share holders. It appears that our lawyers were not on the ball with this case.

Is it correct that cpx didn't employ patent lawyers to fight their case. Does anyone know the answer.

I would expect these answers from the RNS , did we lose this case on the correct point of law . If the answer is yes ,then why didn't cpx lawyers know this law and advise the company against the court case. If the answer is no I would expect cpx lawyers to appeal the decision immediately. I am assuming cpx will now pay the court costs and maxwell costs, I hope I am wrong.

I had hoped good debate might eventually return to this site but with people like you taking over the thread, this will never happen. How stupid do you think people are,stop harping on about how much cash cpx has, when you know any money they have in the bank is because of their yearly fundraising s. What that means is, cpx need to fund raise every year because they have made a lose year after year for at least the last 10 years. Apart from a few good posters, this site is like watching the inmates run the asylum, what a shame.

very disappointing for cpx to sate they will gain next to nothing monitory wise with their case against locus. They did the right thing but were bamboozled by loop holes in American law. I am concerned, xpower batteries will continue to use cpx products and force cpx to sue them in court, which is something the company cannot afford to do. I hope cpx will not be caught between a rock and a hard place.
