It does seem like this is dragging on but the class action group of shareholders in what was AIM listed African Potash (AFPO) seeking compensation from Nomad Cantor Fitzgerald for allowing untrue RNS statements to be issued, seem on the verge of actinn.

Peter Petyt who is organising the case has written the almost 100 punters who want their money back on the grounds that they bought or did not sell because Cantor allowed Potash to issue false claims has written to the group. He states:

Following recent discussions with Counsel, it has been agreed that we will prepare a letter before action on behalf of one of the key shareholders and send this to the Nomad's legal advisers to invite their response. We are hopeful that this will allow Counsel to finalise a positive opinion on the merits of the case, so that we can then proceed to a submission to funders.

We will be meeting with the key shareholder in the next few weeks, so I would anticipate the letter being sent out in the second half of March.

Progress here is slow, I was hoping that the case would be funded and ready to go by now. But such a case is a first and would set a precedent, with alarming implications for other Nomads who have allowed misleading or downright untrue RNS statements to be issued on their watch - one thinks of Cairn & Cloudtag as another clear example of this.
