Playtech gets injunction to stop more Caliplay legal proceedings

(Alliance News) - Playtech PLC on Wednesday said it has obtained anti-suit injunctions to prevent partner Caliplay pursuing more litigation proceedings against the gambling software firm in Mexico.

The dispute between the duo initially centre on whether an option Caliplay had to redeem an additional services fee element of an agreement between the two parties had lapsed. This is the subject of a court in the UK, with a trial set for October of next year.

Last month, Isle of Man-based Playtech noted that Caliplay had issued legal proceedings in Mexico against it.

"Playtech has now accepted service of those proceedings to enable the group to respond to them and is now able to update on the content of the Court filings in Mexico. The actions taken by Caliplay in the Mexican court proceedings contravene the contractual agreements in place since the strategic agreement was originally established in 2014, in particular the agreement between the parties that any disputes would be resolved in England," Playtech said.

An interim measure by the Mexican court was to order all fees due to Playtech under deals with Caliplay be paid into a "court-mandated trust account in Mexico", rather than to the firm directly.

"Other interim measures the Mexican court granted include the suspension of many rights and protections under the agreements," Playtech said.

To "protect its position and ultimately progress towards a resolution" Playtech said it has obtained interim anti-suit injunctions from an English court.

"These injunctions compel Caliplay to stop taking any further steps in the Mexico proceedings, as litigation should not have been commenced in that jurisdiction," Playtech said.

"In Mexico, PT Services Malta has obtained separate interim measures from a Mexico court ordering Caliplay to discontinue the case it commenced in Mexico against the relevant Playtech entities, so that the dispute can be resolved in the appropriate and agreed forum in England."

Playtech said Caliplay "remains a highly important customer" and it hopes to resolve the issue fast.

The company has been reviewing its EUR530 million senior secured notes and its revolving credit facility, both of which mature in the fourth quarter of 2023.
