Seingred you are correct in drawing the distinction.
The reason Zaza probably doesn't want to negotiate is because he is after a judgement against Steve to get at money probably before others like Outrider and Mourant. To arbitrate in this case you need willingness on both sides to come to an agreed position of compromise. I doubt Steve has much to offer that Zaza wants if he is after cash.
The key background is that FRR has at this point in time lost the asset. How close Zaza is to Green in that process will no doubt come out if it ever gets to court to be tested.
I do worry about Steve case here - there is a logic to Zaza responses that is remniscent of Steve's case he tried to present to Cayman on the fiduciary case. We are in the odd position of being as shareholders in this case on Zaza side - however he is clearly after money for his back pay. So in terms of the block 12 license we are on Steve side.
The jump thats needed is GOGC stripping it off Green in Georgia and somehow re-assigning PSA to FRR US on nthe registry over the already completed insolvency where it envisaged Uniserve would have next bite if GOGC blocked.
Thats the bit I struggle to understand how its unwound especially while FTI continue to look at the directors roles and the question of solvency and the original attempt to move to FRR US.
Irrespective of what happens here its the actions in Georgia that will be decisive I think.
Phil . I think you will find that this would be a different form of arbitration to an international arbitration court like icsid . Many here made the mistake of thinking the arb was a negotiating process ,rather than one that gives judgements .
A thought I've had on Zaza wanting to go the court route over arbitration is possibly where it takes place/who presides as in judge/jury or arbiters. I recall with the Arbitration between the GOGC & FRR the arbiters were from various places in Europe, can't recall quite which possibly one from Norway or somewhere. So is Zaza going the court route in the hope of getting a Judge/Jurors from an area that might be thought potentially more favourable to him? Over arbiters that might be thought more favourable to SN/FRR?

I think people were more concerned that any part of it could of been edited to suit whatever agenda and with no access to the master copy you could not know for certain the information was all legit.
Ziggy: no side in the dispute could confirm it was genuine as they needed the permission of both sides to release it! But it was quite clear it was likely to be genuine as it was such a comprehensive document, as was argued by myself and others at the time.
tsbs ....No it seems not , but that does not make those who put their bet on red any more clever or insightful than those who put their bet on black or as some of us did on zero .
All bets were placed with absolutely zilch info as to it being genuine or proof that it was , but the white ball had to land somewhere , luck of the spin .
But BWTF , now just wish I had put my money invested here on the tables instead .

Sorry bud but have to pull you up on statement . Whilst there may have been some of the “brigade “ who disregarded it as fake there were others like myself who argued with yourself and others on the basis that at the time and indeed until very recently no side in the dispute made any comments to confirm the leaked document was genuine . Some of the comments at the time from posters who downloaded the Doc included ....well it looks genuine ....most scams do , don’t they , hence healthy scepticism from some of us .
You had no proof it was genuine and chose to believe it was , it was a 50/ 50 bet on the unknown on your part .
Think at the time it was all about the context surrounding the release .
Njames: the arbitration result was sleuthed out and revealed on here but the "Zaza can do no wrong" brigade on here disregarded it as fake.
You have to ask yourself why it makes a difference that SN is fighting this issue so hard. The dispute seems to be carrying on quite nicely in the courts. But the revelations that are coming out in these court proceedings must be deeply embarrassing for the company, while finally shedding some light for long suffering shareholders on what has been happening in secret. That is exactly why he wants to put it in arbitration, so all can be hidden once again. We likely never would have found out the true results of the arbitration initiated by GOGC absent these proceedings, and many other matters. The company wasn't going to tell. So in spite of ZM apparently being a bad actor, he has done us all a favor by pursuing this action in court.
I am no lawyer but a quick feeling relating to the documents and contents I have a feeling that the need to appeal was already in ZM.s plan and is part of his legal strategy. I fully expect this to run and run for some reason.
