I'm hoping that these few days, has prompted talk between both parties for a reasonable settlement out of the courtroom. The home advantage point still bugs me, I know judges SHOULD be impartial, but I mean really. Surely even if one party does win, I can forsee months of appeals too, not sure if that is a possibility.
Alex
I agree with you Wild judging on all the evidence presented in court we should win easily, especially with the analysis presented by our expert witnesses Sandy Walker and Enzo Carlucci they were brilliant. But I've watched a lot of court cases where I've thought the evidence was logical on one side only for the verdict to go the other way at the end. With our case being decided by one person (who could be biased solely on the fact CPX is an Canadian company) we could so easily loose on a technicality despite suxh strong evidence in our favour.
I think the wrong trial is a farce anyway, for a company to demand the full take over as compensation because a deal failed should never have gone before a judge. To make this case fair and reasonable this should only have been both sides claiming for costs and legal fees from the failed deal - that's all!
PW I watched rather a lot of the case.
To say it is clear every day was in our favour I think is "opinion" rather than fact and it is opinion of people biased in viewpoint.
There was little clear facts on either side I would say.
We saw both sides produce witnesses that argued their viewpoint of the "facts" . Experts from both sides made a case for their side.
Yes, I think overall Cineworld have the better case, but it is for me still an "if"
Yeah Mountainous it came back on about 2am but I'd already committed to an early night by then lol. I was dreading calling BT today and be told I had a fault with a 14 day target fix - maybe having heating controlled by Hive isn't such a great idea afterall - boilers with cover get repaired the next day (if no hot water or heating) but broadband doesn't! I worked for BT for 31 years I know how useless can be with an open fault.
I'm not so sure we will be OK but it would depend on what we are fined if we loose with CPX demanding (insanely and unfairly) the full $2.6 billion. If Barbara decided they should be compensated the full amount and we have to pay it with nothing in return how would it be funded? Borrowing $2 billion for a company takeover is one thing, asking the banks for it to pay a fine for nothing back for that money is another :-( I do hope you are right though! :-)
If people have watched the court case, then you will know that every day was in our favour! Cineplex hasn't come up with anything solid, or based on hard facts. So why are people saying IF we loose for, what facts or reason for the IF? I personally think we will WIN based on facts.
Mountainous,
I am not sure how you get to the conclusion of "we will be ok if we lose "and think we have added any significant money to our cash position since end H1.
Their claim is a multiple of any funds we have.
We are not able to access all cash we have due to certain parts of our lending.
We would be far from ok if worst case scenario we lost to full or near full value of their claim.
Even if we were able to get support to finance it then that extra debt burden would be crippling..
Other options may well see company survive, but could destroy us shareholders stake.
I seriously do not want to face Cineworld losing the case.
Don't think we will, at least not to near value of Cineplex claim. However none of us can guarantee the outcome currently.
Hope that is all fixed now BlueBuxton!
If CP lose after all of that it will be added entertainment value XD
I think if we lose, we will be ok. The drop will be a nice chance to top-up imo. We had a good c. £500m in the bank in June, which has likely become even larger now as we’ve had great trading conditions.
lol Mountainous, I take it you are missing the court case too :-) My memory of Mr Mark will depend on the outcome. If his rude-shouty-false-accusations tactics result in a win for CPX and we have a fine pushing us into further debt and thus knocking down the SP I'm going to be pretty annoyed with him. Anything however above a 0-0 draw (aka a win) I will remember him fondly for his entertainment value (special bus, no no no, dollar earned rant etc etc), I may even buy shares in his bus company lol
I would have been up until 4am too as I usually am but my broadband went off all night (thanks BT), with everything controlled by WiFi lights, TV, Heating now I got fed up waiting for it to come back on so went to bed early :-(
BlueBuxton- sent me into absolute laughter haha, despite his ridiculously hostile courtroom techniques I think we’ll miss him at the end, he’s been such a source of entertainment.
The fact is the GPs have it too easy, for too long now. You can’t make a proper appointment, it’s either morning or afternoon for a phone call. The other week they phoned my mates mother in law, & told her over the fone she got cancer. They will do anything or say anything to not see you in Person, they are an absolute disgrace.
Amazing how quickly those doctors can move to see people face to face when it's at the private practice.
Sammy18, the GPs have actually been told to start and open their doors for face to face appointments by the government, the GPs are refusing, that's why they are saying they will go on strike if they are forced to do it, I would call there bluff, as whats the point now when you can't see anyone? It's like they are on strike already. It's not the governments fault at all I'm afraid.
Anyone messaged the Reddit GameStop mob to target the CINE shorters. Just for a laugh like.
The reason I was told was because the water spraying, while covid is around, which to me is absolutely crazy, if that was the case all the dentists would be shut
Mr Mark will sort your ears out on Monday Mountainous ;-)
Governments way of doing a bit of cleansing PW, stabilise pension deficits etc...
DoctorJ, well thank you for seeing your patients and doing a good job like my sister who works as a specialist doctor in hospital Xxx if the other GPs are that scared why don't they wear the full PE. Absolutely disgraceful, I feel sorry for the older generation. As on the news they are telling everyone not to ring for an ambulance unless in an emergency, but can't see a GP, so instead they don't want to bother anyone and become so very ill, this could or would of been prevented if the could see a GP early.
Grrrr I'm furious.
Get someone else like your wife/partner to do it for you, that link was for a set of 10 hopi candles, £2.99 free delivery Cruise1. The heat absorbs the wax, but do use ear softner first for a week for best results haha. It's what they use at the beauticians.
Good evening Cruis1, I got my ears syringed on the NHS a few months back.
I was having quite serious nosebleeds and my GP referred me to an ENT (Ear, nose and throat) specialist. I visited the ENT and then when we discussed the nose problem I also brought in the fact that my hearing wasn’t as good as it used to be and the inside of my ears felt quite pressurised. There and then, he took me to one of his colleagues who did the hearing tests and found out that my hearing was a bit affected. He told me to use olive oil drops and then return in about a month, and then they syringed it.
Nearly impossible to get it done via the GP, shame the NHS has come to this. These days i’ve found that getting a referral first and then bringing up the problem to the referral works better.
All the best for you.
Hopi ear candles will sort you Cruis, should only cost about £20, or £5 if you buy the candles and do it yourself (not advisable)
Maybe in some parts of the UK it is not possible to see a GP when you want/need to, but where I am we have been seeing patients throughout the whole of the lockdown (including home visits to Covid positive patients).
Paramedics sometimes fail to understand that GPs are not an emergency service in the same sense that the ambulance/police/fire service are. There are booked surgeries and patients with appointments, we can't just up and leave mid surgery to see somebody at home within a 10 minute target time.
GP colleagues who are refusing to see patients are causing problems for the whole profession, but in my own view the hospitals are full up with really Ill patients (NOT all Covid, lots of different conditions), most of whom are really too unwell to stay at home.
Bloody hell haha, I bet that is removed, why all that for a simple link. Sorry everyone.
I can believe that PW, I asked about having my ears syringed, they won’t even do that now on the nhs, got to pay £70 to go private
Mraveragetrader I was talking to a paramedic today, she says the hospitals are not over run by Covid patients, they are busy because GPS will not see any patients! So they are all ringing for an ambulance, half of the people who are in hospital shouldn't be in there she said.
Well it's true about GPs not seeing anyone, my poor mother is running around in circles as her husband has the signs of dementia, and all they are doing is sending the daughter (me) links for carers support!
The paramedic says the GPs will go on strike if they are forced to see people face to face. It's disgraceful how much they are being paid and refuse to see anyone.
