ACCESS TO SUMMARY JUDGMENT FILINGS IN YPF-RELATED CASES

Burford Capital Limited, the leading global finance and asset management firm focused on law, previously noted that summary judgment filings in the YPF-related cases were scheduled to occur on April 14, 2022.

Those filings occurred as scheduled and, like all US federal court filings, are available on the Public Access to Court Electronic Records (PACER) system at www.pacer.uscourts.gov. Users must register for a free PACER account to search for filings, and there is a small fee to access the filings themselves. The YPF-related cases are pending in the United States District Court for the Southern District of New York and their case numbers are 1:15-cv-02739-LAP (for the Petersen case) and 1:16-cv-08569-LAP (for the Eton Park case).

Burford provides this update solely to inform that those filings occurred and the mechanics of accessing them; Burford does not generally issue releases about court filings and will not do so routinely in the YPF-related cases or any other matter. Burford does not comment on the substance of pending cases as it is for the court to determine the matters raised in the filings. Burford notes that filings of this type contain partisan advocacy as is appropriate in the adversarial system of common law justice.

As previously advised, according to the current timetable, the parties are expected to exchange responses to these filings on May 26, 2022, and to exchange replies on June 23, 2022. Thereafter, the process is in the hands of the court, including whether and when to hear oral arguments and issue a decision.
