Introduction
[1] In this application for judicial review, the applicants challenge the decision of
the Minister for the Department of Agriculture, Environment and Rural Affairs
(‘DAERA’) to grant a Marine Construction Licence, a Discharge Consent and an
Abstraction Licence to Islandmagee Energy Limited. These permissions are
associated with the development of a gas storage facility at Islandmagee.
[2] The first applicant is a company formed by a group of local residents opposed
to the development whilst the second applicant is a well-known campaigner on
environmental issues.
[3] The parties have now filed extensive affidavit evidence and the application
will proceed to full hearing in May 2023. In advance of this hearing, the applicants
have brought two interlocutory applications:
(i) To strike out parts of the respondent’s evidence, pursuant to Order 41 rule 6
of the Rules of the Court of Judicature (NI) 1980 (‘the Rules’); and
(ii) For production of an unredacted version of a ministerial submission dated
31 March 2021, pursuant to Order 24 rule 14 of the Rules.
CONCLUSION
[36] Both the applicants’ applications are dismissed, and I will hear the parties on
the question of costs.

I think we are witnessing the embryonic stages of a fantastic company that is rising from the ashes. All the discussions have been ongoing with government ministers is a great sign for the future. We are all aware of what story will unfold, but I have a gut feeling this is going to be extremely positive.
Having previously built the Sicilian at Appledore, I am expecting a positive outcome. All the bits of the jigsaw are slowly starting to come together. Good luck to JW and the team for all their hard work which is coming to fruition.

Therefore, in our case the chance of success in upholding Edwin Poots/DAERA'S original legal authority to grant IM licence = 87%
From all I heard the potential for H&W success is even greater !!!!! Maybe that explains the oysters and champagne.
JWs words a few weeks ago on the UK government strategy for new oil and gas licences and storage facilities
‘Fantastic news this morning, good news for our Gas Storage project at Islandmagee, the largest storage project that is “Shovel Ready” - no other gas storage project is at an extremely advanced stage, having compleated Front End Engineering Design and will take a significant period of time to catch up to the point we are at today.
Substantial amounts of work have also been undertaken looking at suitability of other gases including hydrogen to be stored subject to additional approvals. The need for storage will be driven from excess renewable power generation and the need to store energy and the ridiculously low levels of storage we have survived on in the U.K. whilst importing gas on a just in time basis from Russia.
The larger and more important take away from todays announcements is the realisation that Renewables, whilst a lot of work has and is being done to aid the transition will fall far short in the short/medium term.
Oil and Gas from domestic markets is the only sensible plan to deal with current and expected demand over the next couple of decades. Our Energy Market has seen a significant up tick in enquiries from this sector this year, with live tenders on the street with some due to be awarded this year.’

We shall see based on merits of legality of authority in this action. However, irrespective of outcome, the project WILL go ahead, just different hurdles, in the end game the Government and political clout will always win, ergo, H&W are on a cast iron winner. I agree. I believe if positive, which I believe based on evidence I listened too, that the SP will auto correct to north of 25p and then we will see a flurry of news on finance etc.
As I have stated before our revenue already allotted to 2024 is already above £140 million, the aspirational target being £200 million. This will be blown away !!!
Missionary for the friends of the Earth 😂 still paying back the funds from the island Magee a judicial review costs. That crowdfunding page must’ve got expensive, those pesky expensive barristers 😳💰💰
