Update on London Court of International Arbitration (LCIA) Final Award
Star Phoenix (formerly AIM: STA), an international company (the Company) with an oilfield services business in Trinidad, business presence in China and an oil and gas interest in Indonesia, duly update that, after an arbitration process over a 4-years period which involving a counterclaim sum over US$14m of contractual breach allegation and a moderate counterclaim sum of proceeds from oil sale brought up on the Company by a third party, the Company recently received final award notice from LCIA. The LCIA award dismissed the US$14m counterclaim while awarding the sum of oil sale proceeds to the third party, together with £52,699.57 for their Arbitration Costs and US$226,000 for Legal Costs.
The third party still owes the Company US$171,265 and £49,456 from previous LCIA orders. The Company had also initiated a compensation claims approximately US$2m against the third party in the High Court of Trinidad and Tobago (TT) for unpaid service fees and loans. Therefore, the Company regards the dismissal of the US$14m allegation by LCIA as a favorable outcome given the fact that substantial legal costs in the order of millions of US dollars were saved through utilizing an internal legal representative.
Depending on the outcome of the TT court litigation, the Company will endeavor to minimize the impact of admission cancellation. The Company is currently studying strategies for restructuring. Among several options, the main focuses are:
Continue the ongoing proceedings in Trinidad and Tobago in which the Company is seeking the compensations from unpaid services fees and loans to a third party.
Exploring opportunities on emerging new energy particularly Golden Hydrogen.
Restore admission to trading on AIM.
