Arbitration, though done in delhi court, is not the same as being taken to court and finding a winner and a loser , the parties are expected to behave in a co-operative manner and work within the spirit of getting the problems ironed out amicably , there will be give and take on both sides and the points of dispute on the contract will be discussed with the arbitration teams till an agreement is reached . Gail obviously want to carry on doing business or there would be no interim purchase measures .

RJ-ON/6 has a management committee formed from , indus gas , focus energy,ongc ,dgh and government of india nominees , so it is not just a simple matter of sign and carry on . Problems with other PSC's include the indian government trying to change the parameters of the initial agreements to aquire another %10 of the profit , gail can not legally form another gspa with indus till we have a functioning PSC , even if they wanted to do it straight away , hence the interim term sheets .

Roxton, i know nothing about indus and the Igx , sorry . But this is how some of it works , some pipelines are classed as "common carrier pipelines" , multiple producers put a metered amount of gas in separate connections and it all mixes together , multiple customers hundreds of miles away buy a metered amount of gas and pay the contracted producer whatever they agreed , simples . But you have to be connected to the common carrier pipeline and indus are not as i understand it .

Neither really stew , just had not expected it after previous comments , i,m guessing it is because there are new documents that focus want to admit as evidence , as always information is scarce , the sooner it's over the better .

KB, could be down to flooding , they have to shut down sometimes for safety when lines and transformers are down , some areas have been hit pretty hard .

What you have to bear in mind paddig is that those comments " prima facie " , " balance of convenience " and the other comments from january were used solely to decide on the merits of that case which was to seek an injunction to maintain the Staus Quo , continue to supply gas to gail . The court readily admits towards the end of the statement that the finer points will be worked out in arbitration and not by the sitting judges .

A couple of years ago Gail filed for damages from Gazprom for failure to supply for up to $ 1.8 billion and settled for $285million which is considerably lower , so the settlement here could be a lot lower than the maximum that is being sought .

Either way i see the settlement as clearing the way for progression of business and renewal of the PSC , which can only be a positive thing , fingers crossed . DYOR etc etc .
