RE: Are the Gods16 Jan 2021 15:35
I’m no expert in Brazilian law, but most legal systems have a set of rules which govern litigation. In the U.K. it is called the CIvil Procedure Rules (CPR) CPR 5.3 states.
5.3 Where any of these Rules or any practice direction requires a document to be signed, that requirement shall be satisfied if the signature is printed by computer or other mechanical means.
The U.K. court’s interpretation of this is that an electronic signature is allowed. There have Beenchallenges to the validity of an electronic signature I U.K. courts, ie where somebody has denied they signed a document.
My interpretation of your paragraph is simple. If the prescribed method of electronically signing a document is used for a document which is signed in Brazil, then it will be acccepte led by the court that the document has been signed by the purported signaturee. If the document has been signed outside of Brazil then the validity of the signature is potentially open to challenge.
