Yes mate, but if both Oilex and GSPC can come to an agreement before Arb actually starts, then surely it can be avoided. GSPC will want this as I see us getting the better outcome through Arb, however the time taken to get that outcome would be long......... so not in our favour. Best for both to come to an agreement now, and avoid the long process.
I think of it as arbitration, just with out the arbitrator at the moment, with a view to avoiding arbitration....... :)

If I remember right, the judge was a "holiday" stand in judge, and probably to protect his/her career took the easy option of forcing arbitration, rather than ruling against GSPC and upsetting the Indian Gov :)
