"on 11 December 2018 it signed a term sheet (the "Term Sheet") with a New York, U.S.A.-based fund seeking to secure a loan of up to $60,000,000 (the "Transaction"). The Term Sheet is not a commitment letter, nor a commitment to providing financing to the Company."
Categorical proof that the term sheet has been signed. They would not sign such a sheet in a willy-nilly way but with seriousness.
"The Term Sheet is not a commitment letter, nor a commitment to providing financing to the Company." - is simply standard boiler plate legalese to possibly throw off the shorters - or even to trap them?
Canny old Zaza. I would not put it past him!
I see the following sequence of events: sign a major nomad, reveal bidding war and draw down on the loan - boom and bonfire of the shorts! Bring it on.
