Just read the report from today.

Hopes for the settlement vanished.

Previously there were not a single word about negotiations.

And today….

Following unsuccessful negotiations with the Government of India, the Company has moved quickly to enforce its rights under the Australia-India bilateral investment treaty.

No chance of quickie 10-20x :-(

So you see, it’s not about the amount of evidence!

We might win the case! And get 1b!

But if the tribunal decides in upcoming 1-2m that the seat is going to be in India, this 1b has 99% chance of being annulled.

And sure, I hope my fears are wrong, but as of now I’ve derisking - too much pain from previous surefire experience

I’ve stated my fears, not necessarily it will happen. But I’m painfully aware of the consequences, because last time i also have been sure it’s gonna be western hemisphere, I’ve been royally wrong.

Please, before you say it’s unreal, check the thread of csssius mining on hotcopper, and you’ll see by the share price, how market calculates the chances of any meaningful award, after the tribunal decided it’s gonna have a seat locally - not in the western hemisphere.

Let’s assume:

we get right award with right number in 4 years. Let’s hope for that.

Our tribunal arbiters already decided the seat is in India.

Then, indias government files the annulment application, stating just plain whatever (it’s not important, since it’s local court and everything is already set up and judge is of Indian nationality)

Then it is reviewed by the local court in India

They might, assuming corruption and national favoring, decide „sure, we see that govt has a point, and we decided that award from the tribunal is… annulled”.

Then PAT’s claim is finished….

Rightfully so, for if I might be blunt here - corruption and impartiality (even nation-wise)in locally based (not western) court eats any chance of enforcement of the award.

And this is what I’m afraid of.

Same as any international arbitration.

Annulment happen exactly in the place of the seat of the court, after party that, in fact (not de jure) disagrees with the award.

In case of greenx - annulments is decided right now in the local court of England and wales.

And if in our case - the tribunal decides that the seat is going to be in India, we are royally screwed.

Obviously, in the application of annulment they state manifested abuse of power by the tribunal, lack of jurisdiction, corruption, etc - whatever they want and see fit.

Fact is that, with local court that is in India, obviously, the chances are slimed not in our favor, delicately speaking.

Thing i fear the most - is that PAT gonna repeat the situation of CASSIUS MINING, where their panel of arbiters decided that seat of the tribunal going to be in ghana ====> even the tribunal award 500m, then the govt of the ghana just go to the local cort and they annul the whole award

What they've presented as an evidence makes hell of an impression. 2/3 judges were like best bros, their wives were besties, they were greenpiece lawyers, one of them got a swiss citizenship and did not notify the court, they've ommited part of the evidence and did not address it, they've literraly created a frankenstein-award that made no processual sense, which in many parts contradicts 1)itself 2) logic 3) treaties

Keep in mind these are nominees -

so if someone buys via their bank/fund/hedgefund - they are seen as nominee

it is not the bank mgmt who bought shares

it's clients

so unfortunately, not a sign of anything
