As Screenlearner pointed out, Scampy, the judge in the Markman Hearing determines legal issues surrounding the patent, thus greatly reducing juror responsibility. Jurors will focus on the facts surrounding Samsung's behavior. If Nanoco passes Markman, Samsung likely gets to visit Styx and it's friendly boatman, who might not be so friendly upon discovering that they have no coin to pay for the ride.
