Fitbug Appeals California Court Decision In Fitbit Trademark Case

LONDON (Alliance News) - Fitbug Holdings PLC on Wednesday said it has filed an appeal in the US concerning its trademark dispute with rival Fitbit Inc.

Fitbug's case against Fitbit alleges trademark infringement and unfair competition. It has filed the appeal of recent decision by the District Court for the Northern District of California Northern to the 9th Circuit Court of Appeals.

Fitbit denied the allegations made by Fitbug and successful defended its claim in the California court.

Fitbug also said it is progressing with separate trademark actions in the UK and Europe against Fitbit and is applying to cancel Fitbit's EU trademark registration and is defending Fitbug's earlier UK trademark registration.

"We have discussed the US case with our legal advisors and believe we have strong grounds for appeal. The central issue remains the likelihood of confusion. The company believes that only an injunction precluding the use of the Fitbit mark will eliminate the potential for confusion," said Fitbug Chief Executive Officer Paul Landau.

Shares in Fitbug were up 0.4% to 5.90 pence on Wednesday.
