I'm assuming Andrew Kennedy's efforts have ground to a stop. I wasn't optimistic on chances of success but seems to have aborted before the starting gun got loaded.
I think Andrew Kennedy was as effective in this regard as Rees was at running a company.
Twid, did you not get the latest email from Andy regarding progress?
I have been contacted by a number of you in recent weeks to ask whether the action is still progressing,with some requests more polite than others. I was disappointed that none of these emails offered any assistance with our efforts, which I had previously requested, and instead some of them seemed to almost treat me as someone working for them with a tone that is not becoming of anyone that I wish to partner with and certainly not anyone I would wish to assist.
Just to clarify I am working with a couple of people to move this along, all of us have full time jobs and in many cases have far less to gain from a successful action that most of you. We are working with a law firm who to date has not charged for their time as we have not yet managed to secure funding to cover their services so we are having to be accommodating to their other clients, which can result in delays.
I encourage all of you to get involved and help move this along and to this end, in the next few days, I will share a document outlining some key points on our case. I invite all of those on here to contribute by adding detail to make the arguments for our case. This is something that has been requested by our lawyers and a chance for us to come together and pool our resources and expertise.
Other things that would assist in our efforts:
- Some of you have still not provided the size of your holdings, the higher the level we can raise the more chance we can get funding or at least some assistance with the case. If you have not already done so we need the level of shareholding that you had at the time the placing was announced on the 21st December
- A number of you have specified that you do not want your details to be shared with other investors, this makes it extremely difficult to interact and results in several separate email chains that takes more effort to maintain and increases the chance of messages being missed. Many of you seem to be using false names/burner email addresses anyway so I fail to see why we can't find a better way to communicate. We now have over 30 investors who have expressed an interest in pursuing a case, setting up a group would make it easier to provide the updates that many of you have asked for and to aid in the sharing of ideas. Happy to look at twitter groups,whatsapp or any other medium.

It is unfortunate that I have not been able to be more positive in this message but am hopeful that a good level of engagement on the drafting of the document will allow us to move forward in a much more effective manner and set the tone for the rest of this action.

Paris, France, Eastleigh and Manchester, UK – 21 December 2023 – Novacyt (EURONEXT GROWTH: ALNOV; AIM: NCYT), an international molecular diagnostics company with a broad portfolio of integrated technologies and services, announces an update to the conditional disposal of its laboratory in Taiwan, which it acquired as part of the Yourgene Health plc (“Yourgene”) acquisition completed on 8 September 2023.
On 13 June 2023, Yourgene announced the conditional divestment of its Taiwanese subsidiary, Yourgene Health Taiwan Co Ltd (“Yourgene Health Taiwan”), to INEX Innovate Pte Ltd (“INEX”), a Singapore-based molecular diagnostics company focused on women’s and fetal health, for proceeds of up to US$4m (approximately £3.2m).
As previously announced, the divestment is conditional upon Yourgene completing a pre-Closing restructure (the “Restructure”) to facilitate the transfer of retained people and assets to other Group companies, which must be approved by the Taiwanese Government, and INEX then being granted Taiwanese Government approval for the planned acquisition as required for non-Taiwanese acquirers. The Restructure is now complete, however the various approvals have taken significantly longer to achieve than originally anticipated and management do not expect the transaction to complete by the end of 2023 as previously announced.
Both parties remain committed to completing the transaction and the Group is continuing to work with INEX to obtain the necessary approvals as quickly as possible. Novacyt will provide a further update on the disposal as part of its trading update in January 2024.
