@Barbershop, yes Cineplex made a counter-appeal to our appeal. From what I remember, it was basically saying that in the event that Barbara is overruled and Cineplex is entitled to nothing, then Cineplex should still receive some damages. It’s pathetic, they got off extremely lucky this time and they it doesn’t even appear that they have any substance to their appeal.
All in my opinion.
It has been 5 months since the decision. I think a settlement should have happened if both sides were even the least bit interested.
Mooky even said they are confident in a reversal of the decision.
As is often pointed out, the appeal could have been dismissed at any point if there was no substance to it. CINEPLEX even made an appeal to the appeal. Getting a court date is a good start.

Are we expecting an appeal from Cineplex to shoot down our appeal? Forgot if there is a timeline for them to register that, i.e. within two weeks of us submitting the terms of our appeal....anyone remember?
Does anyone think they could still do a deal between themselves before this goes to court?
Won't be a full blown trial like last time. Simply targeted around the points of the appeal.
The 3 Appeal judges will be familiar with the previous ruling prior.
Has to be some strong grounding in the appeal in the eyes of the Justices for it to be proceeding to appeal and being allocated court time.
Potential is for a substantial reduction in damages and corresponding very substantial rise in the share price.
If you look at the Ontario court of appeal website there are lists of decisions - I looked through about 5-6 decisions and the time between hearing days and decision being reached looks like between 10-14 days.
If that is anything to go by we should know the outcome possibly by the end of October/ 1st week of November

Rightly or wrongly I expect a 2 day appeal verdict sooner than a lengthy original case.
October 12/13 will be the hearing. I would expect it to take 1 week or two to finish. The decision last time took around 45 days as Mountainous said. It can always take shorter or longer depending on the courts.
So is a decision/verdict given on the 13th October or will we have to wait days/weeks?

I can’t find exactly how many cases he has won of those tried but looks like he has been on the winning side of many prominent appeals which is very encouraging
Furthermore this lists names of who are regarded as the best litigators in Canada- both he and Paul Steep are in the list - sufficed to say no one from Goodmans (cineplex) made the list. CINE are clearly throwing the kitchen sink at this to get a result

@mountainous I just turn up 20 mins late and if trailers are still on I wait outside the screen im fed up with them. Worst spoiler was in The Northman recently and of course famously Brideshead Revisited showed the final shot in its!

Yes Top Gun 2 will be good but it's Jurassic Park I can't wait for. As Mountainous knows I walk out of the trailers in case that trailer comes on and ruins it with Spillers! :-)
Just seen are euro entry “Sam Ryder” and I’m sure my grand bet on us getting more than nil-pwa is safe, what do you think BlueBuxton, it’s good watching it on my 55inch LG oled TV but the quality of the screen and the sound from my TV is nowhere near the quality of a Cineworld screen experience.
Top Gun Royal premiere this week. I can’t wait to see on the 27th.
To support with the appeal CINE have drafted this firm and this particular lawyer in to execute for - makes good reading on paper let’s hope they can live up to their reputation on this case
