30 November 2011 Augean Plc ("Augean" or "the Group") Court of Appeal Application Upheld Augean Plc announces that further to the dismissal of the High Court challenge on 3 November 2011 to the Secretary of State's decision to grant permission to dispose of Low Level Waste ("LLW") at the East Northants Resource Management Facility ("ENRMF"), the renewed oral application for permission to appeal to the Court of Appeal has been upheld. While the presiding judge stated that he was "not at all persuaded" that the original judgement was wrong, he felt that the point of law relating to the case needed to be clarified by the Court of Appeal. He was conscious of the delay to this "project of considerable importance" and therefore took the decision to expedite the case. The Court of Appeal hearing is expected to take place in January 2012. Jul 27th 2011 - Edison Investment Research today published a report on Augean (AUG.L, LSE:AUG, LON:AUG) entitled "Positive Pre-close". In summary, the report says: Augean’s pre-close statement highlights that, despite a quiet April, trading has been in line with expectations. In addition, with strict cost controls still in place, net debt has reduced further to £3.5m (H210: £3.9m). As announced on 7 July, the formal commencement on LLW has been slightly delayed pending a challenge lodged in the High Court. However, Augean has been making good progress in commercial discussions and readying the site to receive waste. We continue to believe it is only a matter of time before this opportunity becomes reality and we maintain both our forecasts and positive stance on the group. Interims are due on 27 September.
Time to think about buying with a hold for at leat six months. There is a buz in the waste industry about Augean.
Biffa waste believes that they will get the go ahead to store the low level waste. Interesting to find that Biffa has been following developments in this company.
News of a legal challenge by a local resident against Augean’s (AUG) plans of disposing of low level waste at the East Northants Resource Management Facility pushed the hazardous waste management group’s shares down by 1.875p to 27.25p. “The group will be making every effort to ensure that the process is expedited with the expectation of still delivering capacity in the fourth quarter and into 2012,” the company commented.
Found out today that 4 people in Avonmouth site have been made redundant and others told to re-apply for their jobs. Apparently the HSE have told them to make lots of improvements as they are a low level COMAH site. I don't think it is a major site for Augean.
Environment Agency grants permit to dispose of LLW at East Northants Resource Management Facility Following yesterday's decision by the Secretary of State for Communities and Local Government to uphold Augean's appeal for the granting of planning permission for the disposal of Low Level Waste at the Group's East Northants Resource Management Facility, Augean is pleased to announce that the Environment Agency has granted Augean South Ltd a permit to dispose of Low Level Waste at the site. The permit allows the disposal of wastes with a range of hazardous, non-hazardous and inert properties with low levels of radioactivity. The decision follows a rigorous assessment of the company's application, extensive consultation with the local community and approval from the European Commission. Queues of lorries going in to Augean's Avonmouth site everyday now. Business must be picking up. I noticed the office lady has changed her old Ford Sierra for a relatively new Mercedes. They must be feeling confident.

Singer Capital Markets commented on Augean (AUG), the hazardous waste management group. Following full-year results, the broker has highlighted the "good recovery" in volumes in both divisions, especially in the second half, and the "modest recovery" in the projects and construction markets. With that said, Singer thinks the much anticipated appeal decision on the Low Level Waste planning application, due by 24th May from the Secretary of State, will be the biggest driver of the shares in the next two months. Shares in Augean inched down 0.5p to 27p.

Results for the year at Augean (AUG) were slightly ahead of expectations, the hazardous waste management group announced as its key markets showed continued signs of recovery. For the 12-months ended 31st December 2010, the group posted an adjusted pre-tax of 0.4 million pounds, down from 1.3 million pounds a year earlier, as a result of being impacted by lowered gross margins. Looking ahead, the firm added that it remained "cautiously optimistic about the future trading environment." Augean shares rose 0.5p to 27.5p.
