Consumer association files claim against Arte Radiotelevisivo Argentino S.A.
On 13 February 2023, Grupo Clarín S.A. (the "Company") informed the Argentine Securities Commission and the Buenos Aires Stock Exchange that the Company's subsidiary Arte Radiotelevisivo Argentino S.A. ("ARTEAR") had been served notice of a claim filed against it by Asociación de Defensa del Asegurado Consumidores y Usuarios-ADACU-Asociación Civil (a consumer association), before the National First Instance Court on Commercial Matters No. 26, Secretariat No. 51 ("Asociación de Defensa del Asegurado Consumidores y Usuarios-ADACU-Asociación Civil v. Telecom Argentina S.A. and others re/ Ordinary Proceeding", File No. 003062/2023).
As set forth in the claim, claimant seeks-with respect to subscribers who paid for service plans or service packs that included paid television (as one of the plan's features or as the only feature), in the relevant area of the City of Buenos Aires, certain municipalities in the Greater Buenos Aires Metropolitan Area, the City of Rosario and the City of Córdoba from 1 December 2017 to 31 July 2021-the reimbursement as damages of 1.21%, plus punitive damages of 2%, of all items paid by such subscribers under the plans challenged by claimant during the relevant time period, plus interest, on the grounds that the defendants allegedly fixed prices and engaged in anti-competitive conduct. ARTEAR, with the assistance of legal counsel, shall exercise its defence rights in this litigation.
