Earthport PLC28 January 2005 Press announcement for immediate release 28 January 2005 earthport plc ("earthport" or "the Company") Baltimore update In the matter of earthport's claim against Baltimore, earthport has compliedwith the Court Order made on 21 January 2005 which ordered that in the eventearthport wished to serve evidence in opposition to Baltimore's application tostrike out that part of earthport's Claim Form based on FraudulentMisrepresentation it was to serve its evidence by a final deadline of 16:00 on26 January 2005. earthport complied with that deadline by serving evidence and an amendment toits Particulars of Claim setting out the detail of its claim based on FraudulentMisrepresentation. On Tuesday 1 February the Court will be asked to grant formalpermission to earthport to amend its case. In submitting further evidence and an amended claim in draft, earthportconsiders that it has significantly substantiated its claim for FraudulentMisrepresentation.
