The proposed CCAA Termination Order provides for a release of the Monitor and its
counsel, counsel to the Applicants, the CRO and each of their respective affiliates, officers,
directors, partners, employees and agents (collectively, the “Released Parties”) from any and all
claims against any of the Released Parties, whether known or unknown, matured or unmatured,
foreseen or unforeseen, existing or hereafter arising, based in whole or in part on any act or
omission, transaction, dealing or other occurrence in any way relating to, arising out of, or in
respect of, these CCAA proceedings or with respect to their respective conduct in these CCAA
proceedings (collectively, the “Released Claims”). The proposed release of the Released Claims
includes an express carve-out for any claim or liability finally determined to be the result of the
gross negligence or wilful misconduct on the part of the applicable Released Party.
27. It is my opinion that the proposed Released Parties have facilitated and made substantial
contributions to these CCAA proceedings, including in completing the Transaction,
i think I have always known the outcome but was liking on hope that the first bench brief from PK where he say shareholders will get a GM when the restructuring is all wrapped up and approve by the court, but i think he has change his mind on that one trying to protect there position and the BOD against future claim ?
and although it's hard to take'' we are all just waiting on death perhaps the 13th SEPT ? as someone posted recently'' unless by the act of god we get a reprieve to this nightmare ?
speak again when we get the next statement of de- list or whatever they throw at us before they turn the lights out on posting apart from the few that would look in from time to time to see what MC is doing for his fees, and if there is any luck ?
