Prescription is the acquisition of a right through long use or enjoyment; the law presumes that the right was lawfully granted. There are 3 methods of acquiring an easement by prescription: 1. at common law 2. by lost modern grant 3. under the Prescription Act 1832 Whichever method is relied on, the user must be for at least 20 years and the points set out below apply.
