Assuming it's Nanosys, uopn a guilty verdict all of their major customers using the tech will switch to Nanoco. If resolved by settlement, insist on costs as part of the agreement.

In any new litigation, take it all the way to Court verdict and claim costs. I say definitely do it and focus on Germany where it is quicker, cheaper and can obtain an injunction. Not as expensive as you might think and pretty much all of the leg work has been done already.

Whatever the company's motives, the fund raise from pi's at 37p was on the basis of inflated 'guidance' re the litigation, and the more than reasonable inference that any settlement would be higher than that which has been agreed. On the other hand, the loan note fundraise offered participants a +100% return in the event of a settlement per se, regardless of the value.
FYl, my investment here was not on the basis of the litigation outcome. Makes no difference to my investment decision. However, others do have the right to be peeved and to express such if they so wish.
