Ineffective complaint of a Ba

UNOFFICIAL TRANSLATION

The Management Board of Bank Polska Kasa Opieki S.A. ("Bank") hereby informs that on 7 July 2008 the Bank has been serviced upon a ruling of the District Court for the Capital City of Warsaw, 12th Business Division of the National Court Register, dated 27 June 2008, issued as a result of ineffective complaint of a Bank shareholder, stating that: (i) the referendary's ruling dated 28 November 2007 involving increase of the share capital of the Bank as a company taking over a separated portion of Bank BPH S.A. property (spin-off by separation) remains valid, and that (ii) the referendary's ruling dated 30 November 2007 involving the supplementation of the ruling dated 28 November 2007 remains valid.

Legal basis: Section 39, Subsection 1, Clause 6 of the Ordinance of the Minister of Finance on Current and Periodical Information Submitted by the Issuers of Securities of 19 October 2005.
