Report 99/2008: Dismissing complaint to the decision dated on 21st of May 2008 regarding dismissing petition for securing the claim to repeal resolution No 10 of the Bank's Ordinary General Meeting.
The Management Board of Bank Polska Kasa Opieki S.A. (“Bank”) informs that on 24th of November 2008 the Bank received decision of the Appeal Court in Warsaw from 5th of September 2008 regarding dismissing complaint of the Bank’s shareholder to the decision of the Circuit Court in Warsaw dated on 21st of May 2008 regarding dismissing petition of the Bank’s shareholder for securing his claim to repeal resolution No 10 of the Bank Ordinary General Meeting from 23rd of April 2008, concerning distribution of net profit for 2007 and allocation a portion of reserve capital for dividend pay-out through forbidding the Bank to pay-out dividend or ordering payment of the dividend to the court deposit. Recalling the causes of repealing the complaint, the Appeal Court indicated that the plaintiff did not prove his claim in the meaning of art. 7301 § 1 of the Code of Civil Procedure (k.p.c.).
At the same time, we inform that until now any suit for repealing resolution No 10 of the Bank’s Ordinary General Meeting from 23rd of April 2008 was not delivered to the Bank.
