mmmm possibly ! these things do have a tendency to find a natural equilibrium though! I mean if this spiked to 42p on no news shorts would open, top slices would happen and buys would dry up !! i would imagine or if i were in charge i would add to the nda that any position taken by participants can be neutralized but not closed upon that company withdrawing from the bid process !! To prevent in effect a financial gain from a position if the bidder had a short open they are allowed to buy long to the same amount, and vice versa. Thats what i would do because you cannot expect a company to incur risk after they are no longer involved but nor should they benefit from insider knowledge sooooo you can balance your trade but no more than that.
