You only release an Rns when it can have a fundamental affect on the share price.
You don't have to release one if you are taking advice.

If we have taken this step knowing the damage today's RNS would cause, why doesn't GM soften the blow.
We are obviously confident in winning our battle ?

Surely there is a contract agreed through the tender process at a given price. Unless there is a clause stating the above, we are perfectly within our rights to sell at whatever price we want. It's a supply and demand world that dictates price.
If there were a clause then we wouldn't be fighting a damning legal battle.
