EU Regulation on Advanced Driver Distraction Warning Systems Published

The mandatory fitment of Advanced Driver Distraction Warning (ADDW) systems is one of the new safety features required by EU Regulation 2019/2144 on "the type approval requirements of motor vehicles and their trailers, and systems, components and separate technical units intended for such vehicles, as regards their general safety and the protection of vehicle occupants and vulnerable road users", more commonly referred to as General Safety Regulation 2 or GSR 2. Within (EU) 2019/2144, Advanced Driver Distraction Warning (ADDW) systems are defined as "a system that helps the driver to continue to pay attention to the traffic situation and that warns the driver when he or she is distracted".

Note that Advanced Driver Distraction Warning (ADDW) systems are different to Driver Drowsiness and Attention Warning (DDAW) systems, the fitment of which are also required by (EU) 2019/2144. DDAW systems "assess the driver's alertness through vehicle systems analysis and warn the driver if needed", and the technical requirements which such systems must comply with are specified in Delegated Regulation (EU) 2021/1341.

As specified in (EU) 2019/2144, the fitment of an ADDW system becomes mandatory for all new types of M and N category vehicle (i.e. all passenger carrying and goods carrying motor vehicles) from July 7, 2024, and becomes mandatory for all new vehicles falling into those categories from July 7, 2026.

To support the mandatory introduction of ADDW systems, the European Commission have been developing a Delegated Regulation to specify the necessary technical requirements and test procedures for such systems over the past three years. This work culminated with the publication of Delegated Regulation (EU) 2023/2590 in the Official Journal of the European Union on November 22, 2023.

This new Delegated Regulation specifies that the ADDW system must monitor the direction of the driver's gaze, i.e. the direction in which the driver is looking, whenever the system is in operation. To determine when the driver's attention is "distracted", the draft Regulation defines a specific downward vision area, which is likely to include the driver's lap, the passenger footwell, the centre console, etc. The driver's attention is considered to be "distracted" if the driver's gaze if fixed in this area for a prolonged period (refer to performance criteria bullet point below for details on time periods).

Exciting times at Smart Eye as it announces another 12 hashtag#DMS design wins with a "leading Korean car manufacturer with a global manufacturing footprint." That kindly narrows it down to Hyundai. That's 21 wins so far in December with Hyundai, for a total of SEK300M. Falling in a revenue per design win range of about SEK12-16M, these are probably simple systems for regulatory compliance either in Europe or China.

Smart Eye is following its 2022 playbook precisely. First a new line of credit, followed by a flow of expanded program awards. That suggests coming next is a chunky win with someone new, and the company seems to have been hinting at Toyota already in a recent presentation, probably with Bosch as Tier-1. If that happens it positions the company neatly for a new fundraise.

The DMS suppliers all face three hurdles:

1. Don't run out of cash.

2. Achieve profitability.

3. Continue to invest in an innovation, technology and feature set roadmap to stay competitive.

Cash can be secured from fundraises or licensing deals. Different approaches have been seen. (3) is vital for long-term survival; but delays profitability in (2); which increases risks of losing investor confidence and not having enough cash to survive.

Smart Eye keeps the focus on design win totals, but quarterly cars on the road is a more reliable metric of survival chances, since that correlates with short-term cash generation. Only Seeing Machines publishes that data.

We are reaching the point of a shakeout in the DMS supplier base, simply because not everyone can survive. For institutional investors and financial analysts seeking an expert third-party source to complete due diligence on the DMS suppliers, I can be booked for telephone-based consultancy via GLG and Guidepoint. November saw the UK EV share at 25.7% of the auto market, down from 27.7% YoY. Plugin hybrid volumes grew by 56% YoY, whilst full electric volumes fell by 17%, potentially a hold-back ahead of incoming policy changes. Overall auto volume was 156,525 units, up 9.5% YoY, roughly in line with pre-2020 seasonal norms. Audi was the UK’s best selling BEV brand in November.

While fully automated vehicles are still a ways off, the stepping stone of hands-free driving technology has become prevalent in the past few years. These assist systems allow drivers to take their hands off the steering wheel in certain situations. Combined with automated braking and acceleration, the feature can help make driving long distances or in congested traffic easier and less fatiguing.
