Trisor,
Sorry, but I can't PM you as I am no longer a subscriber (too many errors by the site re prices)
That's better.
After the previous reply from the AIM regulator (see my post of (21st Nov), I have just received the following.
Thank you for your further email, copied below, regarding Nanosynth Group plc (the “Company”).
"We appreciate that you would like to be provided with details of the outcome of any consideration by AIM Regulation of the matters which you have raised. As previously advised, please be assured that we investigate all enquiries regarding alleged breaches of the AIM Rules for Companies and for Nominated Advisers. Where we identify, actionable, evidence of failures to comply, we take action as may be appropriate to the circumstances. However, we are unable to discuss specific matters or provide updates. We understand that this may be frustrating for you but our approach to confidentiality, which is similar to that of other regulators, is designed to protect the integrity of our regulatory work.
We note your reference to the Company’s notifications of 17 January 2023 and 16 May 2023, which followed the Company’s notification on 6 April 2023 providing an update on its financial position at that date. In this regard, noting your comments, should you wish to provide copies of any other material which you consider would assist us in our understanding of your concerns, please do so2.
I have forwarded as much evidence I have, re RNS's issued by the company.
Lets hope they have the desired effect.
I know I am repeating myself, but please put pressure on both the FCA and the AIM regulator to take action.
Yes, the shares are now officially worthless, with any monies or value left going to creditors. Shareholders will be bottom of that list.
Any fight for compensation is useless, but the fight for justice must continue.
I am determined that any of the board member responsible for breaking LSE rules, plus any criminally illegal acts are bought to book.
No reply from The Telegraph within the 10 days I gave them to reply, so now forwarded all my evidence to The Times.
Not holding out much hope, but determined to go down fighting.
My total loss is just above £4,000 so I know that many have invested and lost more, so I hope there are far more than me who have complained to the FCA and contacted the media.
Please flood the FCA with a complaint, as they are unlikely to take any action if they receive complaints in single numbers.
Trisor,
Unfortunately I won't be able to see you PM as from last Monday i am no longer a subscriber to this site.
But if you can post your message here, unless it contains info you do not wish to be shared openly, then I will completely understand if you do not post.
As far as I am aware the only recourse anyone has regarding actions, or lack of by the FCA is the UK Treasury and Parliament.
Make of that, what you will, but my view is that to complain to the Treasury or Parliament would be a complete waste of time.
That is why, if I can get the media involved (The Telegraph still has till the 25th of this month to accept an article, before I offer the evidence I have to another newspaper) I consider that the best option to expose any wrongdoings.
Just received this from AIM regulation.
AIM Regulation considers all enquiries as regards the conduct of AIM companies and nominated advisers in respect of their compliance with the AIM Rules for Companies (“AIM Rules”) and for Nominated Advisers (“Nomad Rules”), and takes action where appropriate. Please note that AIM Regulation's remit does not extend beyond the AIM Rules and Nomad Rules. Further information regarding the remit of AIM Regulation, and that of other regulators and competent authorities, can be found at the following: AIM Regulatory Landscape.
As indicated, we can assure you that we consider all enquiries and investigate alleged breaches of our rules. However, you will appreciate that confidentiality is essential in maintaining the integrity of our work and, accordingly, please note we are unable to comment on individual enquiries.
Kind regards,
AIM REGULATION
My reply.
"Whilst I appreciate confidentiality, surely if a company has been reported to you and is found to have broken the rules, the person who has complained deserves a reply of any result, otherwise what is the point of complaining."
Tuan6,
I agree with your comments re the AIM, but I know there are more than myself that have put in complaints to both the FCA and the LSE.
Presumably it is someone on this chat that has sent me a private message, but as I am from today no longer a paying subscriber to this site (far too many errors), I can not access PM's any more.
Cheers,
I will put updates regarding my actions on here as soon as I get any.
If I do not receive any updates, I will note such on here once a week, just so no one thinks I am ignoring the issue.
Thanks for that Jp1959
I think I read that article in The Telegraph or some other paper a few days ago.
I will leave it another couple of day, then if no reply from The Telegraph who I offered the details re NNN for consideration of publication, I will try to contact Charles Archer direct.
Update....
I have received a reply form the FCA (2 working days), directing me to the most appropriate department for directing any complaints against Nanosynth Group.
report allegations of market abuse (they sent me those details via a link, so not sure if you can report direct this way)
Plus the by e-mailing aimregulation@londonstockexchange.com
Although I feel there is less than a 10% chance I will achieve any justice via these methods, what I am certain of, is that if you do nothing then the chance of success is Nil.
I am also awaiting a reply from The Telegraph.
I agree that it probably won't happen, but I for one won't let it go without a fight.
If no one kicks back at such behaviour, they the AIM will continue to be the jungle that it is.
So this dog has finally been put out it's misery.
No chance of a late minute recovery.
The fight continues to make sure that those responsible for it's death are bought to justice.
Update.
Note, unless you are an employer, past or present of a company you are complaining do not report via whistle@fca.org.uk.
I did so, and they forwarded my complaint on, stating that I should receive acknowledgment within 3 working days.
TheArts,
That's more or less my take on it, but your views are helpful and appreciated, thanks
Not that big an order, so I await those negative ever eager posts, but this order gives us a nice foot in the now open door.
As the saying goes, great oaks from small acorns grow.
Srcdel,
The whistle- blower route is one that I am taking, both with the FCA (but see my previous post)and the media.
I am intending to discuss with a newspapers legal dept re my e-mail received from Chris Farrington (Resolvegroup uk) stating his reply to my e-mail was strictly confidential, and should not be shared with any third person, even though I have not signed or had been asked to sign any confidentiality agreement prior to receiving the reply.
I am almost 100% certain of my legal obligations re this (Resolvegroup have no grounds) but I am looking to double cover myself.
I appreciate that releasing such to the FCA and the Media is a different beast when it comes to confidential disclosure of information.
Won't post again till I can give more info re if my actions are going to have any effect.
For those intending to complain to the FCA, please do so, although my complaint sent several weeks ago has not even been acknowledged with a case or ref number.
At least the information in my complaint can be passed to the media.
Nothing yet to add, except that I am determined that those responsible for any misleading or possibly corrupt practices will pay.
What I would ask, is that all who held shares with this company, complain to the FCA.
If you don't fight you can never win.
