I realise that you addressed your post to Dr.A, but can I just jump in here with an observation. As far as I am aware, Peel haven't paid PHE the fee for the exclusive right yet, so I'm not really sure that PHE have been prevented from building their own DMG unit if they had wanted to, or taking a share in another SPV with another party, e.g. a local authority. So in that respect, I'm. not convinced that PHE's hands have been tied so far.
Another point, Dave Ryan said several times that although they had lots of interest from other potential customers, everyone wanted to the second, no-one except Peel at the point was prepared to go first. So I don't believe that Peel was preventing PHE doing something themselves or with another party.
And finally, I don't know the details of the exclusivity agreements with Peel or HUI or anyone else, but I would be surprised if PHE tie their own hands in these agreements. It would make sense if they retain the right to enter into a SPV shareholder arrangement with someone else. In other words, surely the exclusivity agreement can't exclude PHE themselves?
