i agree with your first two points.
on the last point i agree the co will very likely say all has been done that can. but if the LFN is still present at levels that impact locals, then it can be actioned - this is not under the companys control. the motivation of the locals is not a point the law would consider.
it is this lack of control of the situation the company can exereice (as well as the real difficulty in predicting LFN attenuations) that initiated my initial comment on this BB that i saw the deal with the contract as good for the contractor , but also gave the co the credit for getting any contribution from the contractor.
you can have an opinion the matter will go away regardless of outcome of the latest measures, but this does not make it a fact. it is a fact the law provides for council and locals to action if the matter continues.
