based on your recent posts i take back my prior criticism of you and apologise for some of my comments against you personally made in the past. however i remain of the view the 7E deal has not been value added to prior to deal shareholders- this is proved by the sp ! without question in my view the sp is being held back by the non-completion of the 7E deal (it has slipped by 3 months in last 3 months!). this will be a drag until the deal is sorted and put to bed. by the way.. look at that 22K ..it is mainly gas at fixed price..no way is it the same as 22K of oil at market rates.. anyway.. good luck

GS. i would suggest the "fee" is likely to be a min / % / cap..say $20M first slice / 25 to 30% / say $75M cap..only guessing based on prior experience so no idea if this is anywhere close to the RKH reality. as an investor i treat any award as a one off bonus if and when it happens - i attribute nil npv to it currently.

It is binding arbitration with I think three arbitrators. This type of arbitration is largely binding ( I think only appealable on process and quantum (money) not on liability. The fact Rkh is funded by a no win no fee deal, one can take comfort that monies awarded will be paid- it�s the first thing funders check!

nice summary of several issues! (are your sunday surmmons equally condensed to the salient points? LOL) just pick you up on one point - the EPS is very unlikely to change the RF upwards..that will come much later in the production life..it could change it downwards (due to water break through)..but that issue has been discussed at great length and anyone reading this and is invested on a medium or long term basis can not believe that risk is material to the investment case- so no further comment required.

i agree with your first two points. on the last point i agree the co will very likely say all has been done that can. but if the LFN is still present at levels that impact locals, then it can be actioned - this is not under the companys control. the motivation of the locals is not a point the law would consider. it is this lack of control of the situation the company can exereice (as well as the real difficulty in predicting LFN attenuations) that initiated my initial comment on this BB that i saw the deal with the contract as good for the contractor , but also gave the co the credit for getting any contribution from the contractor. you can have an opinion the matter will go away regardless of outcome of the latest measures, but this does not make it a fact. it is a fact the law provides for council and locals to action if the matter continues.

daytrader..sorry for the delay in responding to your response! the EA are only involved as the process falls under the IPPC regs. - for most noise matters they are not involved. the ultimate legal control is the Environmental Protection Act 1990. the legal duty to enforce this rests with the council but the act allows for individuals to act if the council does not. it is an interesting point of law that the council have a duty to pursue and abate noise nusience and it is not determined by IPPC compliance or otherwise. should the council (or locals) be minded to action and the co use a "we have done everything we can" defence, the magistrate (in the first instance) would have to balance the employment etc benefits of continuing operations with the dis-benefit of in effect restricting operations. i have been involved in a number of similar cases dating back to prior to the 1990 act! (when the control of pollution act 1974 was the controlling legislation) a supreme court ruling a few years back (fenland tigers) in effect established the legal principle that until the noise has existed unchallenged for 20 years it must be considered on its merits regardless of compliance with planning consents or RA / IPPC compliance. so if the measures do not work and abate the LFN sufficiently there is the clear risk of challenge via the courts. this is not something the co can control. i would note the approach they have taken in the assessments etc looks very reasonable and considered - but that is not a defence in law! given i think the chances of the measures working is slim i remain of the view this is an unquantifable risk as an investor. but never mind that is only my opinion!
