Yo: I would think not as presumably the only way they can do that is with information from FRR, which they're hardly going to be in a rush to produce. I think that the lawyers have bigged up the urgency of the threat to get the court to agree to the TRO promptly and without too much digging.

None of the defence seems to address Hope's right to do what he has done, just the implications of it, or am I missing something? It doesn't address directly repaying the interest, or the default, other than to talk about Hope consistently blocking new finance, which has got us to this perilous financial situation.
I don't see the relevance to this case of talking about the impact on the 4m people in Georgia!

It looks like a strong defence to me but would be great to get Oopsi's view. They haven't yet started the process of trying to get the $150m facility so I suspect that that is pretty remote and irrelevant tbh.

But this information has only come from Hope's side hasn't it; and they may not have all the details and would probably only release the bits they believe would help their case? So it could be only a proposed farm out for example. Please correct me if I am wrong. We are feeding on scraps as we have been all year and trying to piece together a jigsaw where most of the pieces are missing.

To me this smacks of panic and desperation on Hope's behalf as, if he is going to win the case, then why rush into this course of action now? If he fears that the restraining order will be granted and then he will lose then he might try to get the assets like this. Bwtfdik! Oopsi?

Presumably FRR will argue that they have been forced down this route owing to lack of capital resulting from Hope blocking all the financing and thus not acting in FRR's interests. It implies that the Durham loan hasn't happened and perhaps we aren't in a financial position to agree on OOCS. bwtfdik ... or any of us.
