Timster: your timeline is accurate. The things that could upset it are that the liquidators are successful in getting at the assets or an oocs is agreed. Both could happen at any time but probably unlikely before the injunction hearing.

frol: it was something about the shares bring removed from portfolios or something and to get share certs. Anyway just something procedural following the delist. So not new news. Other brokers had done it before.

Great stuff! This is really important as the Durham loan provided a facility specifically for debt repayment (to pay off Outrider). So if Hope's motives were as he claims then why on earth would he want to block the loan?

Although reading between the lines of the new document it seems that we probably didn't submit a declaration of solvency.

I was in CHL, which was delisted, and the Board on here had about one post every fortnight and it never was removed so I don't think we have anything to worry about ... especially with the resident idiots on board!

As it is in the court document we can probably rely on it being fundamentally true.

AJW: Bugsy found in the agreement that the asset can be transferred from one company to another without the GG approval.

Can someone please clarify where we have been told that the assets have been moved as it seems to have been generally taken as gospel on here? The reason I ask is that from my (generally unreliable) memory it came from an ADVFN poster complaining about it having happened. Is it in any of the legal submissions?

Also, if the liquidator deadline had passed without us submitting a declaration of solvency then surely ADVFN would be crowing about it? (I am not expecting one to be submitted; jmo).

Has anyone emailed the liquidator to ask whether a declaration of solvency has been submitted and, if so, whether we can see it?
It might be sensible if one of us did it rather than all of us...?!

Meanwhile back on Planet Earth we await the expiration of the imminent deadline for a solvency declaration to be filed. If it isn't then the liquidator will take the next steps in the process and go after our assets, which may or may not, be accessible to him in either the short or the long term. Whilst that happens our injunction application is set to fail next week and we will be landed with a bill for Hope's legal costs.

Arnie: Taffy kindly shared the contact details of the liquidator on here yesterday so I suspect he will get a shed load of email requests for an update! Given his impartiality and our vested interests one would have thought he ought to be happy to share whether there has been a declaration.
