Wobble, Enyo Law walked away from the case, they quit and they did not get paid. LIA tried to appeal the ruling against them but the appeal was denied.
Goldman Sachs won the case but not without severe reputational damage.
Regardless, Enyo have their work cut out and my feeling is that the case against Slovenia will rest on whether it was reasonable for them to request an EIA from AST, which if you remember AST refused to do.
In my mind, that was an ill advised decision. AST had previously submitted an EIA but between then and the request to resubmit, European Environmental Law had changed and Slovenian policy on “fracking” or stimulation had also changed.
If AST had revised and submitted an updated EIA, things might very well have been different.
I could be wrong of course… time will tell and in this case, time will be measured in years as any outcome will no doubt be followed by appeal after appeal.
