For anybody in any doubt about the 2024 ammendment this can be searched at WA Legislation website, you're looking for the currency date which in effect makes it current Legislation. MAY 2024 is what I found.

As gex(westmount) are not current permit holders any issued will be NEW by current legislation and therefore entitle Gex to rights over any helium and hydrogen unless there is no hydrocarbons present.

I think where deadly is confused bless him is no Legislation currently enacted for the extraction of helium and hydrogen without the presence of hydrocarbons.

You don't need 11 new permits because it will be a new permit applied for under current legislation which includes the 2024 ammendment!

When the various regulations have been drafted and approved to coincide with the Petroleum Legislation Amendment Act 2024, the definition for regulated substances will include Hydrogen and Helium specifically.

An existing title holder will be able to apply for the rights to those regulate substances. All new petroleum permits granted will include the rights to regulated substances too
