Doesn't matter what has been spent. The problem in a nutshell, atm no one knows why it got rejected / not approved or more importantly, will it succeed a third time.
If someone knows what the problem is and how to fix it - its the bargain of the century but such person/company is not going to give much credit for sunk costs [cause they are not going to tell anyone to get the co on the cheap]- thats not how it works I fear.
If you have two parties who think they know how solve it, that's better.
Of course, passing Phase 3 is only half the battle as holders know.
