4D is very much muddled with US listing... so hard to predict but with DNL I am more confident that a sell date is approaching. IPO could do with a cool 60-70M pay by selling this and have a pot for the new team to take it forward. Before the proceedings, the patent owner submitted new claims withdrawing the autoimmune disease indication. (Three divisional applications claiming priority over EP 2,575,835 were granted on 29 April 2020: EP 3,178,483, EP 3,539,548 and EP 3,552,613. The issued patents include claims covering the treatment of autoimmune diseases.) After three days of oral hearings, at which numerous auxiliary claim amendments were discussed, the EPO issued a decision upholding the validity of the following amended claim (amendments underlined):
1. A composition for use in a method of treating or preventing a disease selected from infectious disease or allergic disease in an individual by inducing proliferation or accumulation of transcription factor FoxP3-positive regulatory T cells, the composition comprising, as an active ingredient, bacteria belonging to the genus Clostridium comprising spore-forming bacteria belonging to Clostridium clusters IV and XIVa in combination, which combination induces said proliferation or accumulation of transcription factor FoxP3-positive regulatory T cells in said individual.
In brief, the EPO dismissed or rationalized the insufficiency-of-disclosure arguments and focused on the patenteeâs novel recognition that it was the induction of FoxP3+ regulatory T cells by bacteria in the specified clusters that had therapeutic benefit. The panel argued that by directly connecting the mechanism, regulatory T cell induction, to the treatment of the recited diseases, the mechanism identifies âa new clinical situationâ to which clinicians can adapt their therapeutic approach, for example, to avoid problems associated with FMT. On this basis, the EPO decided that the patent distinguished over prior art that did not recognize or was silent regarding the importance of the regulatory T cell induction by formulations including bacteria in the recited clusters.
While each case is decided on its own merits, the outcome in this case is clearly encouraging for patent owners in the microbiome therapeutic area, given the number of opponents and nature of the arguments the opponents raised.

Challenge of a microbiome patent: lesson from Europe
Patent oppositions are widely used to attack granted patents at the European Patent Office (EPO). The 2019 opposition proceeding against European Patent No. (EP) 2,575,835, owned by the University of Tokyo and exclusively licensed to Vedanta Biosciences, was closely watched as a potential indicator for how microbiome therapeutic patent claims would stand up to aggressive challenge. The claims, drawn to compositions for use in the treatment of infectious disease, autoimmune disease or allergic disease, attracted six challengers: Nestle, Seres Therapeutics and four anonymous opponents. Claim 1 of the patent as issued reads:
1. The patent was challenged on the following grounds:

Sufficiency of disclosure (Article 83 European Patent Convention; parallels 35 USC § 112(a))
The opponentâs filings included the following arguments:
(i)
it was not plausible that all diseases in the claims could be treated using the subject bacteria;
(ii)
it presented an undue burden to determine which of the many bacterial species encompassed by the claims have the FoxP3+ regulatory T cellâinducing effect;
(iii)
the disclosure does not adequately describe how to identify a strain as âspore-formingâ; and
(iv)
it is implausible that infectious disease could benefit from an increase in immunosuppressive FoxP3+ regulatory T cells.
B.
Novelty and inventive step (Articles 54 and 56 European Patent Convention; parallels 35 USC §§ 102, 103)
The opponents cited over 120 prior art references, including an abstract regarding the treatment of IBD, and prior art relating to FMT, which, as argued by the opponents, inherently included spore-forming bacteria belonging to Clostridium clusters IV and XIVa in combination. (Because the international application that led to the European patent claimed priority from an application filed before the enactment of the America Invents Act in 2013, some of the references cited would not qualify as prior art against counterpart US patents.)

Thanks, Tim for replying- Just wondering if there is gas seeping from somewhere, where do you think it is coming from? PG and boys are claiming that they have found a potential Kitchen in MOU-4 based on the 2D and analysis of the migration patterns so far from the mud logs of MOU-1, while drawing parallels between Rharb and Guercif basins. Wonder what is your take on this type of extrapolation?
Also, tried very hard to find a statement from PRD/PG in RNS saying they were expecting to find âsuch and suchâ amounts of gas from MOU-1, can you help me find it?
Btw, I am still crossed with these PRD robbers who took 3.25M from the market with those 2 placings and now will get a âgiftâ of 1M for becoming an operator in Morocco - I will be gutted if they blow that amount for drilling MOU-4!!!
Nigel â Why should investors bother with PGâs estimates or probability of finding gas? Granted he has 30+ years of experience in the field that I do not, even then, he has conflict of interest if he says ââWe have 60% chance of finding gas at MOU-4ââ being the CEO of the company and drawing salary from our money.
The only other puzzle that is not fitting for me is his rush to drill MOU-4 this year itself. Having satisfied the conditions for the 1st phase of the licences (to drill at least 1 well to the TD of 2000M), I expected him to âwaffle aroundâ waste time until this period of the licences expires, so that he can start again for the next cycle, raise money and draw salary for 3 more years through our money all the while dangling this 1-2 TCF gas prospect carrot and throwing âgreenâ side stuff of T&T and Ireland.
Wonder what is the rushâŚ. A puzzle for me!!!

I am totally disappointedâŚThey have fooled us in to thinking that we will be producing from this wellâŚ. I had too many expectations from PG, I expected him to point the drill bit at MOU-1 and find the gas in the 1st attempt in a region which has no natural gas production history. I thought he secretly obtained this information when he was Woking with Fastnet and using it now to take advantage, how dumb I was!!! He fooled us all in to spending ÂŁ2.5M for MOU-1 to get this information, even now we will not be 100% sure, are we?

Agreed that this drill was important but look at the MC of this companay.... Also, don't forget they have raised 3.25M for 25M shares... and will get 1M deposit back after this drill.... do you know the cost of each drill here.. I would say do the math and you will know that they have the money... TT is small so is the cost of running the show... 170K/year.. so unlike some craps like BPC, this will not be a sink hole

Most of us have low averages, mine is 3.5p, so not too worried about losing the investment, which could be the reason for this silence. Even soâŚâŚâŚâŚ
Based on the result of this drill, I will access the potential of where this company can go. While 40 BCF+ could be commercial, at the core, this is an Irish business and everything else is to facilitate the success of Irish projects. A good find (above 100BCF) will improve odds for Ram head project success, while any commercial find can fund further field explorations with minimal dilution.
The odds are good but will have to keep our fingers crossed!

I am not too hung up on this result as I know that the current SP is anchored by the potential revenue from TT, so currently there is zero weightage for Morocco result on the SP. However, I think a negative result will affect 1 or 2 Irish projects, again, I trust PG to know what he is doing and so far, he has delivered on his plans.

Starchild: It's really unfortunate that while you acknowledge my post but, you couldnât acknowledge my silence till this post. My post will only hurt the âpersonâ who is managing this share with no skin in the game, but it will help the âpersonâ who has 10âs of millions of shares invested.
In all honesty Starchild, how can you share the ownership of this company with a CLN lender who can just takeover the company if the loan is not paid? If the company does well, they will get the 1st dips and if the company struggles then they can take over everything, sell and recover their money.
See the scenario now, if you and other PIs do not cough up ÂŁ5 million while diluting yourself, the CLN cannot be drawn at 8p. We all know how successful the open offer funding call was before percy-1, even then, PIs did not put their money, what are the chances now that too for ÂŁ5M, I wonder!
I just couldnât fathom how someone who runs their own business and been successful at it to has 100âs of thousands of pounds to invest into BPC, not understand the risk reward benefit left in this stock. Hence, my conclusion that you were not invested and the reason for my last post.
However, if you are a genuine investor, I wish you very well and will repent for my action⌠as you know KARMA cuts both ways.
