I think it's difficult for us to make a unbiased call on judge Preska's decision, or maybe not , her decision should be made on a point of law requirements, does she need to know the by -laws of Argentina around this case to make a fair USA court judgement, probably yes and no to be fair, Argentina are not stretching this case out any further than most big American cases, 7 years is often normal in big settlement cases, though it does seem a very long time to me, it's nearly always the stalling tactics that cause the longest delays,
I actually thought she might. if possible accept a restrictive shortened fact finding discovery amendment by -Laws in - Arg - and a full discovery around the potential BUR settlement figure, that way it might tempt both parties to accept, burford know that ARGENTINA will appeal anyway if burford only get there way, and still stretch this out and making the best use of the pandemic to stall things even further , so maybe a we bit more of bartering to split the difference, or maybe everything I've said here cannot be done, I honestly don't know,
I thing judge Preska will easily see that Argentina's case is completely all about stalling tactics, though her hands maybe tied to court procedures and protocols , so a compromise of some sort or another might keep her looking fair minded.
I know one thing bar Argentina going completely broke, our case was settled for us when Argentina paid out $5 billion to REPSOL IN 20114. And they never re-sued REPSOL for that money back because of any old Argentina's By-Laws.
And yes JAMMYC CLARIN does seem to be a highly respected newspaper in Argentina with I'm sure a big following.
I don't know if burfords shares are going up or down tomorrow, but I would expect the general market will go down tomorrow alongside the American market, it's actually a very volatile world right now and for the foreseeable future , cheers everyone.
