My educated guess is the the above was discovered when the mill was being relocated as per the extract below from a RNS

A latent defect is an unforseeable curcumstance (FM) as it cannot be identified at installation or commissioning

i have procured many new pumps that have failed and you cant just change to pump housing. You cant just change the motor as the electrical cables from the BMS are sized for the FLC and RC

We used the same FM to save paying penalty clauses as the handovers were not acheived because of this

For this reason I believe GR’s FM call is bullsh*t. If I was a court I’d throw it straight out.

Canmax wanted more than PREM would accept. This is a perfect way to protect PREM and shareholders and is fully legal

If I was Canmax I would hand in that notice regardless of the FM and hope the court backdates 90days from letter. (Assuming they want to put the notice in which I don’t)

How a man can claim he didn’t expect major issues with a new type of mill is beyond me.

Unless you have superman vision, you will not see this under general installation or commissioning. It isnt a major issue or snag, it is a latent defect of the plant which is causing issues

Canmax wont be agreed within 2 weeks.
