but what i dont understand, is that Stark are responsible for the plant until handed over to Prem and they must have known through prem the first supply date, so why havent they been given LAD's (Loss and Ascertained Damages) in their contract. Surely there must be financial penalties for stark for not hitting those delivery dates. This is normal practice under Uk JCT or NEC contracts. However, i dont know what the T&C's are under a FIDIC contract.
