DHSC had a right of reply. They might have filed something but it wouldn't have changed the figures or the main thrust of the claim so NCYT wouldn't have RNS'd it. Parties will now be going through disclosure (exchange of docs). I would be shocked if DHSC had a smoking gun. More so I suspect their record keeping at the time was in disarray. One only has to look at how much PPE they ended up buying to see what the mood music was like at the time
Neil, barristers aren't really involved in the settlement process unless its on the doorsteps of the Ct. Now that they have drafted the statements of case their involvement is usually fairly limited until trial unless there are any interim apps. Most of the heavy lifting during the meat of the claim (documents, evidence etc) is done by the solicitors. SH are a strong outfit. Interestingly, DHSC haven't instructed sols and are managing in house. This tells me that DHSC aren't really in this for the long haul and that issuing was a strategy to force NCYT to accept less at the negotiation table. As much as I don't like it, its not a bad tactic and I think it will work.

DRB, there are obviously some out there just looking to cause mischief. But, the fault also lies with the company. It has failed to articulate the effect of the claim in a clear manner and so perhaps the market expects worse than what you describe. Ultimately this has led to the decimation of SH value.
Hi K, interesting suggestion but they would know that a decent number would still stick around and would be even more cheesed off. I think something else is afoot and a TO seems most likely. Just a question how low will they (the bidder) go...
