On the potential timing of a move to the higher CC (Commercial Companies) listing - the main current restriction on that happening is the LAT shares which mean ONT doesn't meet the eligibility rules around compliance with the UK Takeover Code. When those expire on 5th October ONT can cancel them and that removes that restriction.
The Board then need to decide if the change to the CC category is in the company's interests (it's not automatic). There are some additional costs and admin involved, although less than there was before under the old listing regime, and I think they still need to issue a prospectus (need to check that) covering the key points.
For inclusion in the December Index review they would need to complete everything, including FCA approval, between 6th Oct and 6th Nov to be eligible. So that's maybe a bit tight, but if they are already considering the possibility then they could start preparations (admin, legal, etc.) in advance. Otherwise it would be into next year. I don't think they need shareholder approval to move up so that would avoid the need for a GM resolution.
Will they make the decision? I suspect they might given the increased visibility of a FTSE 250 listing, but that's up to the Board to notify if it's happening. There is currently no time limit to remain in the Transition category, although the FCA have indicated that may be reviewed in future years.
