Why would a pre production payment be paid before commencing production?

Doesn't say anywhere in the contract that if odx doesn't produce any or enough tests to repay the pre production payment, that odx would have to then repay the amount themselves.

Also in contract pre production payment would be paid back to government by deducting an amount ftom the work done for government. Not ODXs fault government failed to let them do any work tso they could repay the pre production payment.
