A few thoughts in response to a couple of issues raised last evening.
From the SGS website “The trial, named ARCADIA, will commence with Professor Evans and the Excalibur team having sourced investment from Mubadala of Abu Dhabi, one of the world’s leading sovereign wealth funds, Excalibur itself and several high net worth individuals. This is in addition to funding secured from the UK Government through the UKRI / Innovate UK programme.”
In much the same way that Vela has invested with SGS to acquire an economic interest in the Asset, it appears that the same arrangement has been agreed with EML and other investors, although we do not know specific amounts or % returns. The relationship with EML does appear to be more than just as an investor though as they are now taking a more prominent role with managing the newsflow and the commercialisation aspects as well.
The Oct RNS states that SGS has acquired the right to develop and commercialise the Asset. I see this as a Licence Agreement with AZ retaining the IP. This may explain why the deal states that Vela receives 8% of proceeds “in excess of £19.2 million and after deduction of sums payable to the major pharmaceutical company”.
We now move forward 8 months to the Angelfish/Igraine RNS dated 11 June which states “EML has secured exclusive rights to and owns the patents on a drug, AZD1656”. Maybe a little simplistic but I just see this as a different use of the term rights. In this context, AZ has transferred the Patents over to EML but I would think that SGS has retained the rights to use the Asset as per the original Licence Agreement (assume novated over to EML).
Why did EML acquire the patents and what did they know at the time or was it just a speculative punt? How does this now impact the payment to the major pharmaceutical company? We probably won’t know the full details or even need to but no matter, just hoping for great results Mon week and a corresponding mega deal that makes this long wait worth it for us LTHs (and the world of course).
