Let's summate the position you have got yourself into this morning

1. There wasn't any arbitration. Actually there was arbitration but it stalled. Actually it didn't stall it failed.

2. There was no award decision made by the arbitration process. Actually there was an award decision made by the arbitration process but it's so small as to be meaningless.

3. Zheng and Choo are so bright that they will run rings round GST and so sure that they will win that they will counter sue. Actually they haven't counter sued but that's ok as it's a sign of the strength of their case.

4. GST are so inept that they waited 16 months to instigate action. Zheng remained a directors of Semnet into 2025 and the final payment for the purchase wasn't made until December 2024. So the basis for the claim most probably didn't come to light until 2025 Chaebol. So, like everything you have posted, your 16 month claim is equally confused and wrong

Now you should know that one of the two directors stayed working for Semnet after the deal completed, which I'd guess is where part of the strength of the case lies. Unlike in the two spurious examples you provide Chaebol

Let me explain the difference to you really simply then Chaebol.

In the case of Semnet, clear material damage has been done to the business as evidenced by the awarding of costs to Semnet by the tribunal.

In the two cases you reference, they are totally woolly, with no damages realised as the employees hadn't actually gone to work for the new employer.

I've been subject to these latter contract clauses myself, they are never enforceable.

Where proven damages have arisen, it is completely different
